Komisja Nadzoru Finansowego realizuje wcześniejsze zapowiedzi o dokładnej kontroli towarzystw ubezpieczeniowych w ich praktykach dotyczących OC komunikacyjnego. Tym razem zastrzeżenia Komisji zostały skierowane do firm należących do grupy BRE: BRE Ubezpieczenia i mBanku. Obie współpracują przy sprzedaży polis komunikacyjnych dla klientów banku.
Nadzorowi nie podobają się przyjęte przez firmę rozwiązania: aby uzyskać informacje, ile kosztowałoby ubezpieczenie, należy zalogować się używając danych, które mają tylko posiadacze kont. Firma też od początku swojej działalności podkreślała, że to oferta tylko dla klientów mBanku.
Jak mówi Łukasz Dajnowicz, rzecznik Komisji, KNF analizuje ofertę BRE Ubezpieczenia w kontekście ustawy o ubezpieczeniach obowiązkowych. Podkreśla, że z informacji zawartych w dokumentach złożonych do uzyskania zezwolenia na wykonywanie działalności ubezpieczeniowej nie wynikało, iż zawarcie umów ubezpieczenia obowiązkowego uzależnione będzie od zawarcia innej umowy, np. rachunku bankowego.
To wszystko powoduje, że sprawa może wzbudzić zainteresowanie Urzędu Ochrony Konkurencji i Konsumentów. A jest to tym bardzie prawdopodobne, że UOKiK już jesienią ubiegłego roku piętnował kilka towarzystw za uzależnianie zawarcia umowy ubezpieczenia od zawarcia innej umowy, np. rachunku bankowego. Jak mówi Małgorzata Orzeł-Kołodziejczyk z UOKiK, w tej sprawie nie jest prowadzone postępowanie, ale jest szansa, że urząd przyjrzy się bliżej tym praktykom.
Dodatkowo wątpliwości nadzoru budzi fakt, że zgodnie z ustawą o ubezpieczeniach obowiązkowych żaden ubezpieczyciel prowadzący działalność w grupie 10 (ubezpieczenia OC komunikacyjne) nie może odmówić wystawienia polisy. A w BRE Ubezpieczenia to zawarcie umowy jest utrudnione, choć, jak deklaruje firma, nie niemożliwe.
Jak mówi Joanna Antoniak, rzecznik BRE Ubezpieczenia, klienci, którzy nie posiadają konta w mBanku, mogą zawrzeć umowę ubezpieczenia bezpośrednio w towarzystwie. Wyjaśnia również, że kalkulacja przeprowadzana jest dla danego klienta po podaniu przez niego niezbędnych danych i klient otrzymuje ją w ciągu 48 godzin roboczych. Według Joanny Antoniak jej firma dziennie odnotowuje kilka takich przypadków.
Wszystko to na pozór wygląda dobrze, ale… oferta dla klientów, którzy nie zawierają umowy ubezpieczenia przez internet jest droższa, dlatego do tej pory zdecydowało się na nią jednie kilku klientów. Całą sytuację firma tłumaczy wyższymi kosztami obsługi.
Może zastanawiać również fakt, że informacji o takiej możliwości nie ma jednak na stronie internetowej mBanku. Instrukcja Jak kupić polisę? nie przewiduje wystawienia polisy dla osób, które nie są klientami, jest natomiast zachęta do założenia konta. Co ciekawsze w świetle wyjaśnień towarzystwa, na razie jednak firma nie widzi potrzeby zmiany procedur.
