Ogólne warunki ubezpieczenia (OWU) są wzorcem zawierającym standardowe postanowienia umowy typowej dla danego rodzaju ubezpieczenia. W odróżnieniu od OWU, sama umowa ubezpieczenia określa elementy indywidualne, np. identyfikujące strony, określające wysokość sumy ubezpieczenia, itp. Formalnie rzecz biorąc, OWU nie są częścią umowy ubezpieczenia ale kształtują stosunek prawny tej umowy.

Umowa ubezpieczenia jest na ogół zawierana w trybie przystąpienia (czyli adhezji) ubezpieczającego do umowy opartej na takim wzorcu ustalonym przez zakład ubezpieczeń.

Treść OWU określa w ubezpieczeniach obowiązkowych – Minister Finansów w formie rozporządzenia, a w ubezpieczeniach dobrowolnych – zakład ubezpieczeń dla każdego rodzaju ubezpieczenia prowadzonego przez danego ubezpieczyciela.

Umowa ubezpieczenia i OWU powinny być formułowane jednoznacznie i w sposób zrozumiały. Postanowienia umowy ubezpieczenia i OWU sformułowane niejednoznacznie interpretuje się na korzyść ubezpieczającego, ubezpieczonego lub uprawnionego.

Zakłady ubezpieczeń mają obowiązek doręczenia ubezpieczającemu, który jest konsumentem tekstu warunków przy zawieraniu umowy ubezpieczenia oraz zamieszczania OWU na swojej stronie internetowej.

OWU nie mogą być sprzeczne z przepisami kodeksu cywilnego dot. umowy ubezpieczenia, które mają charakter bezwzględnie obowiązujący.
