2 października przygotowany w Ministerstwie Sprawiedliwości projekt o uchyleniu ustawy o giełdach towarowych oraz o zmianie niektórych innych ustaw regulujących wykonywanie niektórych zawodów (tzw. II transza deregulacji) trafił do konsultacji społecznych i uzgodnień międzyresortowych. Wśród przewidzianych do uwolnienia zawodów znajdują się m.in. pośrednicy ubezpieczeniowi i aktuariusze.
II transza deregulacji obejmuje 91 zawodów, których regulacja pozostaje w dyspozycji Ministerstwa Finansów oraz Ministerstwa Transportu, Budownictwa i Gospodarki Morskiej. W tym gronie znalazły się zawody brokera i agenta ubezpieczeniowego oraz aktuariusza, co będzie wymagało nowelizacji ustawy z dnia 22 maja 2003 r. o pośrednictwie ubezpieczeniowym oraz ustawy z dnia 22 maja 2003 r. o działalności ubezpieczeniowej.
Broker ubezpieczeniowy
Resort sprawiedliwości przypomina, że obecnie konieczne jest zdanie egzaminu przed Komisją Egzaminacyjną dla Brokerów Ubezpieczeniowych i Reasekuracyjnych powoływaną przez Ministra Finansów na wniosek Komisji Nadzoru Finansowego. Przygotowany przez MS projekt proponuje rezygnację z egzaminu w przypadku posiadania sześcioletniego doświadczenia zawodowego w zakresie ubezpieczeń, odpowiedniego do zakresu działalności. Ponadto w przypadku konieczności złożenia egzaminu, nowelizacja przewiduje obowiązkowe zwolnienie zdającego z tych części egzaminu, które zostały zaliczone na uczelni wyższej (z tzw. tematów egzaminacyjnych, o których mowa w ustawie o pośrednictwie ubezpieczeniowym i w przepisach wykonawczych do tej ustawy) Zwolnienia tego będzie dokonywała Komisja Egzaminacyjna dla Brokerów Ubezpieczeniowych i Reasekuracyjnych na udokumentowany wniosek kandydata. Projekt proponuje także rezygnację z wymogu średniego wykształcenia.

Czynności agencyjne mogą być wykonywane przez osobę fizyczną, która spełnia m.in. wymogi dotyczące odbycia szkolenia prowadzonego przez zakłady ubezpieczeń, zakończonego zdanym egzaminem. MS proponuje rezygnację z egzaminu na agenta ubezpieczeniowego. Ponadto projektuje się rezygnację z wymogu średniego wykształcenia.
Aktuariusz
Jako alternatywę obowiązku złożenia z wynikiem pozytywnym egzaminu aktuarialnego resort sprawiedliwości proponuje możliwość uzyskania tytułu aktuariusza przez osoby, które ukończyły studia wyższe pierwszego i drugiego stopnia albo jednolite na kierunku studiów w obszarze nauk ekonomicznych, matematycznych lub fizycznych, obejmującym co najmniej wiedzę, umiejętności i kompetencje objęte zakresem egzaminu aktuarialnego, a także przez okres co najmniej 6 lat wykonywały czynności z zakresu matematyki ubezpieczeniowej, finansowej lub statystyki pod kierunkiem aktuariusza. Dodatkowo w przypadku konieczności złożenia egzaminu aktuarialnego nowelizacja ustawy proponuje obowiązkowe zwolnienie zdającego z określonej części egzaminu obejmującej zagadnienia, które zostały zaliczone zdanym egzaminem na uczelni wyższej w toku ukończonych studiów wyższych pierwszego i drugiego stopnia albo jednolitych. Zwolnienia tego będzie dokonywała Komisja Egzaminacyjna dla Aktuariuszy na udokumentowany wniosek kandydata.
