Straty, jakie w ostatnich latach ponieśli ubezpieczyciele w wyniku oszustw, przekraczają kwotę 186 milionów złotych. Zdecydowana większość wyłudzeń, zarówno pod względem liczby, jak i wartości kwotowej ma miejsce w dziale II, w szczególności w ubezpieczeniach komunikacyjnych. Znacząco wzrosła również wysokość strat z tytułu przestępczości w dziale I.
Według sporządzonej przez dr Piotra Majewskiego z Podkomisji Przestępczości Ubezpieczeniowej Polskiej Izby Ubezpieczeń analizy przestępczości ubezpieczeniowej w 2008 r., zaprezentowanej podczas seminarium Katedry Ubezpieczenia Społecznego SGH i PIU p.t. „Przestępczość ubezpieczeniowa i metody jej przeciwdziałania”, łączna wartość wyłudzeń w ubiegłym roku wyniosła 56,136 mln zł. Kwota ta dotyczy jedynie 2615 spraw wykrytych.
Niska wykrywalność oszustw ubezpieczeniowychrnWedług samorządu ubezpieczycieli, na jedną wykrytą sprawę, 200 pozostaje niewykrytych. PIU szacuje, że w 2008 r. z 30 mld zł wypłaconych przez ubezpieczycieli odszkodowań od 1,8 mld do niemal 7,5 mld zł stanowiły wyłudzenia. Dla porównania: według raportu opublikowanego przez Stowarzyszenie Brytyjskich Ubezpieczycieli (ABI), w 2008 r. w Wielkiej Brytanii udało się wykryć oszustwa o wartości 730 mln funtów, o 30% więcej niż w 2007 r. Według ABI, koszt przestępczości ubezpieczeniowej na Wyspach jest obecnie szacowany na 5,2 mln funtów dziennie. Organizacja policzyła, że oszustwa ubezpieczeniowe przyczyniają się do zwiększenia średnio o 44 funty rocznie kosztów ubezpieczeniowych każdego gospodarstwa domowego. Koszt niewykrytych oszukańczych roszczeń wynosi 1,9 mld funtów rocznie, co oznacza wzrost o 24% z poziomu 1,6 mld funtów dwa lata temu.
Z analizy dr Majewskiego wynika, że w latach 2006-2008 zostały wykryte 20.936 czyny przestępcze dokonane przez klientów zakładów ubezpieczeń na łączną kwotę 186,064 mln zł. Aż 20.460 czynów przypadało na dział II (15.016 w 2006 r., 2.918 w 2007 r., 2.526 w 2008 r.), zaś łączna kwota wyłudzeń z ubezpieczeń majątkowych wyniosła 179,549 mln zł. W dziale I wykrytych zostało476 oszustw (238 w 2006 r., 149 w 2007 r., 89 w 2008 r.) na łączną kwotę 6,515 mln zł ( 1540,5 tys. zł w 2006 r., 1306,5 tys. zł w 2007 r., 3668 tys. zł w 2008 r.).
Najczęstsze zdarzenia, na podstawie których próbowano wyłudzić, bądź też wyłudzono odszkodowania to w dziale I upozorowanie zgonu, samookaleczenia oraz zatajenie istotnych informacji przy zawieraniu umowy, natomiast w dziale II to upozorowane kolizje i kradzieże aut, upozorowane pożary i włamania oraz fikcyjne straty w przedsiębiorstwach.
Profile oszustówrnDr Piotr Majewski zaklasyfikował przestępców ubezpieczeniowych do trzech kategorii. Pierwszą z nich są sprawcy zawodowi. Osoby te wg Majewskiego utrzymują się wyłącznie z przestępstw, między innymi z wyłudzeń odszkodowań z towarzystw ubezpieczeń. Drugą kategorię stanowią sprawcy sytuacyjni. Ta grupa dopuszcza się przestępstwa ubezpieczeniowego tylko w obliczu tzw. konieczności gospodarczej lub dla pozyskania funduszy niezbędnych do utrzymania siebie lub firmy. Trzeci rodzaj przestępców to sprawcy okazjonalni. Ci oszuści decydują się na wyłudzenie odszkodowania w sytuacji, gdy nadarza się okazja do jego łatwego zrealizowania (np. gdy zaistniało zdarzenie wykluczające uzyskanie odszkodowania, a poszkodowany chciałby je otrzymać).
Pomysłowość przestępców
Bez względu na rodzaj ubezpieczenia, usiłujący wyłudzić odszkodowanie wykazują się dużą inwencją.
– Fantazja oszustów nie zna granic. Najczęściej by wyłudzić świadczenie sprawcy (w ubezpieczeniach komunikacyjnych – przyp. AM) powołują się na nieprawdziwe okoliczności. Rzekomo poszkodowany nakłania kierowcę innego samochodu aby winę za kolizję wziął na siebie i tą drogą umożliwił wypłatę odszkodowania z tytułu własnej polisy OC – mówi Robert Dąbrowski, zastępca dyrektora w Biurze Bezpieczeństwa PZU .
Innym przykładem jest upozorowanie kradzieży nieistniejącego pojazdu, tzw. feniksa.
– Metoda polega na zakupie uszkodzonego pojazdu w stanie wykluczającym naprawę, np. po pożarze i przedstawieniu do ubezpieczenia autocasco identycznego modelu samochodu, a następnie zgłoszeniu szkody kradzieżowej z tego tytułu. Zdarza się również, że kradzież pozoruje właściciel auta, który uprzednio zgłosił roszczenie z tytułu jego uszkodzeń. Przedmiotem takich manipulacji są oczywiście auta, które nie zostały naprawione po wcześniejszym zdarzeniu – tłumaczy Dąbrowski.
Ekspert zdradza, że nagminną praktyką jest celowe powiększanie rozmiarów szkody oraz pozorowanie kolizji z udziałem pojazdów w rzeczywistości uszkodzonych we wcześniejszych kolizjach i już zgłoszonych do roszczenia. Do oględzin oszuści przedstawiają również uszkodzone części, które w rzeczywistości nie pochodzą z danego pojazdu.
– Dużą popularnością w tym procederze „cieszą się” poduszki powietrzne i przednie reflektory, które przedstawiają stosunkowo dużą wartość, a ich montaż wiąże się z minimalnym nakładem pracy. Nieuczciwi warsztatowcy przechowują uszkodzone elementy popularniejszych modeli samochodów by wykorzystać je w dogodnej sytuacji – mówi Robert Dąbrowski. Dodaje, że o skali oszustw świadczy fakt, że na każdej giełdzie samochodowej bez trudu można nabyć wystrzelone poduszki powietrzne.
Również w innych krajach przestępcy ubezpieczeniowi wykazują się niebywałą pomysłowością. Potwierdza to opublikowana przez „Puls Biznesu” lista 10 oszustów ubezpieczeniowych wszechczasów. Na przykład Curtis Donald Keene, farmer ze stanu Georgia, zakopał swój ośmiotonowy kombajn do zbioru bawełny tylko po to, żeby wyłudzić odszkodowanie. Inny oszust, John Darwin, zaginął w 2000 r. podczas spływu kajakowego. Policja uznała go za zmarłego, zaś żona Darwina odebrała pieniądze z polisy na życie. Pięć lat później na policję w Londynie zgłosił się pewien człowiek, który twierdził, że cierpiał na amnezję i został uznany za zaginionego. Okazało się, że to John Darwin, który po upływie kilku lat ukrywania się w Panamie nie mógł opanować tęsknoty za Anglią. Darwin wraz z żoną upozorował własną śmierć, by jego druga połowa mogła podjąć pieniądze z ubezpieczenia na życie. Oboje zachowali tajemnicę nawet przed dziećmi, które naprawdę myślały, że ojciec zmarł. Oszustwo wyszło na jaw tylko dzięki fotografii małżeństwa zrobionego w Panamie po zniknięciu Darwina.
Najpopularniejsze przedmioty wyłudzeń
Jeśli chodzi o rodzaje ubezpieczeń, w których w 2008 r. popełniono najwięcej czynów zabronionych, to w dziale I liderem były ubezpieczenia na wypadek zgonu – 25 czynów, stanowiących 35% ogólnej liczby przestępstw w ubezpieczeniach na życie, na łączną kwotę 2.915 tys. zł. Z kolei w dziale II zdecydowanie najwięcej czynów zabronionych dotyczyło komunikacyjnych ubezpieczeń OC – 1126 czynów, stanowiących 44% ogólnej liczby przestępstw w ubezpieczeniach majątkowych, na łączną kwotę 13.036 tys. zł (25% ogólnej sumy oszustw w dziale II).
Zagrożenie przestępczością zorganizowaną
Rafał Stankiewicz, członek zarządu PZU SA, zwraca uwagę, że oszustwa nie są tylko dziełem pojedynczych osób. Coraz częściej zdarzają się przypadki zorganizowanych grup przestępczych. Jedynym zadaniem właściciela pojazdu jest wówczas przekazanie kluczyków i dokumentów samochodu podstawionej osobie, bez zgłaszania kradzieży do czasu ich zwrotu. Członek zarządu ubezpieczyciela podaje przykład jednej z grup oszustów, która na podstawie posiadanych dokumentów (najczęściej sfałszowanych) samochody o dużej wartości, pochodzące z USA lub Wielkiej Brytanii. Legalizacja i rejestracja ograniczała się tylko do załatwienia formalności z dokumentami, a samochody nigdy nie przekroczyły granic Polski. Sprawcy uzyskiwali potwierdzenie opłacenia akcyzy lub cła, niezbędne oceny techniczne i rejestrację pojazdów. Po otrzymaniu dowodu rejestracyjnego, karty pojazdu i tablic rejestracyjnych sprzedawali samochód za pośrednictwem autokomisów podstawionym kontrahentom. Pojazdy najczęściej były nabywane na kredyt bankowy lub za pośrednictwem firmy leasingowej. Wymogiem kredytu jest ubezpieczenie AC pojazdu i takie też ubezpieczenie sprawcy nabywali za pośrednictwem współpracujących z nimi agentów ubezpieczeniowych. Po jakimś czasie przedsiębiorczy biznesmeni zgłaszali ubezpieczycielowi fikcyjne kradzieże, a ten wypłacał odszkodowania. Przedmiotem jednego z roszczeń był fikcyjny samochód marki Porsche Cayenne, ubezpieczony na kwotę 200 tys. zł. Stankiewicz podkreśla, że w tym przypadku udało się zapobiec wypłacie odszkodowania. Z kolei inna grupa przestępcza miała na swoim koncie wyłudzenia w kwocie 1,5 mln zł.
