W związku z rozbieżnościami w orzecznictwie Sądu Najwyższego, dotyczącymi prawa do zadośćuczynienia za krzywdę (szkodę osobową), należnego osobom bliskim, a zwłaszcza członkom rodzin osób ciężko poszkodowanych, np. wskutek wypadku komunikacyjnego, Rzecznik Finansowy złożył wniosek o uchwałę Sądu Najwyższego. Zdaniem Rzecznika takie prawo powinno im przysługiwać.
Przypomnijmy, że powołane wyżej rozbieżności, a co za tym idzie wątpliwości Rzecznika pojawiły się w związku z uchwałą Izby Kontroli Nadzwyczajnej i Spraw Publicznych SN z 22 października 2019 r. (sygn. akt I NSNZP 2/19), która w odróżnieniu od wcześniejszych uchwał SN, m.in. z 27 marca 2018 r., orzekła, że osobom bliskim poszkodowanego, znajdującego się w tzw. „stanie wegetatywnym”, nie należy się zadośćuczynienie za szkodę osobową.
Przypomnijmy też, że zapytanie do Sądu Najwyższego o rozstrzygnięcie rozbieżności to jedno z uprawnień Rzecznika Finansowego o znacznym wpływie na praktykę rynku finansowego, m.in. w odniesieniu do zakładów ubezpieczeń, zobowiązanych do odpowiedzialnosci na podstawie ubezpieczenia OC komunikacyjnego
