postanowienie ogólnych warunków ubezpieczenia autocasco, według którego ubezpieczeniem nie są objęte szkody spowodowane kradzieżą szczególnie uchwałą, jeżeli była ona następstwem rażącego niedbalstwa właściciela pojazdu, nie wyłącza odpowiedzialności zakładu ubezpieczeń, gdy w określonych okolicznościach zaplata odszkodowania odpowiada zasadom współżycia społecznego (art. 827 § 1 k.c.).
