Sąd Najwyższy 13 marca 2012 r. w odpowiedzi na zagadnienie prawne przedstawione przez Rzecznika Ubezpieczonych podjął uchwałę (sygn. akt III CZP 75/11) o następującej treści:
Uzasadnione i konieczne koszty pomocy świadczonej przez osobę mającą niezbędne kwalifikacje zawodowe poniesione przez poszkodowanego w postępowaniu przedsądowym prowadzonym przez ubezpieczyciela, mogą w okolicznościach konkretnej sprawy stanowić szkodę majątkową, podlegającą naprawieniu w ramach obowiązkowego ubezpieczenia odpowiedzialności cywilnej posiadaczy pojazdów mechanicznych (art. 36 ust. 1 ustawy z dnia 22 maja 2003 roku o ubezpieczeniach obowiązkowych Ubezpieczeniowym Funduszu Gwarancyjnym i Polskim Biurze Ubezpieczycieli Komunikacyjnych, Dz.U. Nr 124 poz. 1152 z późn. zm.)" .
